Terms of Service

1. Scope
Company DROSTE Lederwaren owner Dorothee Decker , Hochstrasse 27 in 45894 Gelsenkirchen-Buer (UST-IDNR .: DE124987844) offers consumers goods for sale on the Internet.
In addition to the statutory provisions, these general terms and conditions apply exclusively to business relationships between the shop operator and customers, unless otherwise agreed between the parties. A consumer is any natural person who concludes a legal transaction for a purpose that can neither be attributed to his commercial nor his independent professional activity.
The shop operator does not recognize any conflicting or deviating terms and conditions and hereby expressly objects to them. Conflicting terms and conditions of the customer are only valid if the shop operator expressly agrees to them in writing.


2. Conclusion of the contract
The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog.
By clicking the "Order" button, you are placing a binding order for the goods in the shopping cart. The confirmation of the receipt of the order follows immediately after sending the order and does not yet constitute an acceptance of the contract. We can accept your order by sending an order confirmation by email or by delivering the goods within five days.


3. Prices and shipping costs
The prices mentioned are final prices, ie include the statutory value added tax. The shipping costs depend on the products ordered and will be clearly communicated to you in the order process before you submit your binding order. Please see our shipping summary page for details. Click here:


4. Payment, due date, default in payment
Depending on the possibility, payments are to be made as agreed (prepayment, PayPal) without any deduction. The purchase price including all costs is due upon conclusion of the contract. In the event of default in payment or the suspension of payments by the buyer, all claims that have already arisen become due for payment immediately. The respective payments are offset against the oldest due claims. We reserve the right to refrain from further deliveries of goods to the customer or to only deliver the goods against advance payment. If the payment deadline is exceeded, dunning costs of EUR 5.00 will be charged for each reminder. The buyer has the opportunity to prove that we suffered less damage.


5. Delivery and shipping conditions
The delivery of the purchased items takes place on the dispatch route to the delivery address provided by the customer. Collection by the customer can be arranged at any time. The purchased items will be shipped immediately after receipt of payment. We only send our goods as an insured shipment with DHL.


6. Transport damage and obvious defects
If you recognize transport damage to the delivered goods / packaging upon delivery, we ask you to have this confirmed in writing by the employee of the transport company upon acceptance of the goods and to inform us about this. Failure to provide a written confirmation has legal consequences for your Warranty rights have no consequences. However, they help us to assert our own claims against the carrier or the transport insurance. If you can, we ask you to photograph the damage to the packaging. You are not obliged to do this. Obvious defects in the ordered goods must be reported to us within a period of two months from delivery of the goods. The notification must be in text form (e-mail, letter, fax, etc.) to:

7. Part deliveries
The shop operator is entitled to make partial deliveries insofar as this is reasonable for the customer. Additional shipping costs are only incurred if expressly agreed.


8. Retention of title
The delivered goods remain the property of the shop operator until they have been paid for in full.


9. Right of withdrawal / consequences of withdrawal

a. Right of withdrawal:
You can revoke your contract declaration within 14 days without giving reasons in writing (e.g. letter, fax, e-mail, etc.) or - if the item is left to you before the deadline expires - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before the fulfillment of our information obligations according to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

b. Consequences of cancellation:
In the event of an effective cancellation, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If you are unable or partially unable to return or surrender the received service and benefits (e.g. advantages of use) or only in a deteriorated condition, you must compensate us for the value.
You only have to pay compensation for the deterioration of the item and for any benefits drawn if the use or deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. "Checking the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a shop.
Transportable items are to be returned at our risk. You have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet received the consideration or a payment at a higher price for the goods at the time of cancellation have made the contractually agreed partial payment. Otherwise, the return is free of charge. Items that cannot be sent as parcels will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your declaration of cancellation or the goods, for us with their receipt.

10. Place of performance, place of jurisdiction, applicable law
The relationships between the contracting parties are governed exclusively by the law applicable in the Federal Republic of Germany, excluding the UN sales law.
